Anger Builds As People Learn About Flagstaff’s Overreaching Party Ordinance

The Arizona Daily Sun recently highlighted opposition by Flagstaff Liberty Alliance and Councilman Jeff Oravits to Flagstaff’s overreaching party ordinance. Now, opposition is growing stronger as people realize it could interfere with their right to assemble. Yesterday, a friend sent me a link to a move on petition started by John Bower called Repeal Ordinance No.2015-08.

In the petition description Bower says:

“Ladies and gentlemen, this ordinance cannot stand.

For one, this ordinance was passed May 20th, after most students had departed the city for Summer vacation, which in itself shows the intent of the Flagstaff City Council to pass this ordinance as a sly way of cultivating more income through broad policy making.

Second, this ordinance would endanger the “peace and tranquility” of families and group living situations of 5 or more, including generational homes, which leaves room for harassment and discrimination against the underprivileged who may not have the funds necessary to “spread out”.

Finally, this ordinance effectively violates students and citizens’ 1st Amendment Right to Assemble by punishing them for gathering for or even being in proximity to a “nuisance party” to which a police officer(s) respond.

The Flagstaff City Council is victimizing and threatening citizens and students in an unconstitutional, but highly profitable, manner. We have already failed at allowing this ordinance to pass. We can correct our mistake by petitioning the Flagstaff City Council in order to counteract the gross discrimination against students and families, and the violation of a right guaranteed by the United States Constitution.”

As of the writing of this post, the petition has 473 signatures.

If you feel this ordinance is too broad and would like to see it repealed, please contact the entire Flagstaff City Council at:

    I would encourage everyone to contact all city council members demanding repeal of this onerous ordnance. Also contact AZ ACLU with your concerns, we may be able to get a law suit going against the city on this. http://www.acluaz.org/

    The more noise we make the better (lets make sure its more than 5 of us and lets become a “nuisance” ha ha)

    The petition is fine and all but its Change.org which is kind of meaningless. We need a LOCAL petition.

      Agree 100%. Council doesn’t listen to anything from Change.org. Contacting council and the ACLU is much more effective.

    Good work! What can the rest of us do to help? Are you laying out a canvass plan, or making telephone appointments to get more signatures? How many do you need to get a referendum on the legislation?

      Thanks! To get a referendum on the ballot, we would need to collect over 1,000 signatures within 30 days of the Ordinance passing. That gives us just a few weeks. With summer break and most of the students gone it is just not feasible to go that route. We simply don’t have the resources to make it happen. We are looking into lawsuits and other avenues. Unfortunately, only Flagstaff Liberty Alliance showed up to oppose when this was voted on. If we had had more opposition up front we may have been able to stop this. We are grateful that Councilman Jeff Oravits stood up for what was right and voted no.

    As of right now, the petition is nearing 2000 signatures. If I can garner that mind of awareness, we can mobilize and get actual signatures on an actual petition. We can do this together, please shoot me an email and we can get started.
